Terms and Conditions

These Terms and Conditions govern your access to and use of ShinyVerse, including browsing, account use, product purchases, preorders, live shop purchases, payments, shipping, returns and customer support.

2. Scope and acceptance of these Terms

By accessing our website, creating an account, placing an order, joining a live sale, buying a preorder, or otherwise using our services, you agree to be bound by these Terms and by any policies referenced in them, including our Privacy Policy.

If you do not agree with these Terms, you must not use the website or place an order. If you use the website on behalf of a company or other legal entity, you confirm that you have authority to bind that entity.

Mandatory consumer rights under applicable law are not limited or excluded by these Terms. If any provision conflicts with mandatory consumer protection rules, the mandatory legal rule will prevail.

3. Eligibility, accounts and security

You may browse the website without an account, but some features may require registration. You agree to provide accurate, current and complete information when creating an account or placing an order.

You are responsible for maintaining the confidentiality of your login details and for all activity under your account. You must notify us immediately if you suspect unauthorised use of your account.

We may refuse access, suspend accounts, cancel orders, limit purchases, or block transactions where we reasonably suspect fraud, abuse, chargeback misuse, automated purchasing, market manipulation, violation of these Terms, or unlawful activity.

4. Products and product information

ShinyVerse sells trading card game products and collector items, including but not limited to singles, sealed products, graded cards, promos, preorders and live shop products.

We try to ensure that product names, images, descriptions, prices, stock levels and other details are accurate. However, minor errors, typographical mistakes, image differences, stock discrepancies, or pricing errors may occur. We reserve the right to correct errors, update product information, cancel affected orders, or contact you for confirmation before fulfilment.

Product images are provided for identification and presentation purposes. For some products, especially sealed items, accessories, preorders or multiple-quantity listings, the image may be representative. For individual cards, we aim to provide clear information about the item being sold whenever possible.

5. Trading card condition, grading and authenticity

Raw card conditions are described in good faith using common collector terminology such as Mint, Near Mint, Excellent, Lightly Played, Moderately Played, Heavily Played or Damaged, or similar condition descriptions. Condition assessment is inherently subjective and may vary between collectors.

Graded cards are sold according to the grade and grading company shown in the listing. Third-party grades are issued by the relevant grading company and not by ShinyVerse. We do not guarantee that any graded card would receive the same grade if resubmitted, crossed over, reviewed, or evaluated by another grading company.

We take authenticity seriously and aim to sell genuine products only. If you believe that an item you received is not authentic or materially not as described, you must contact us promptly with clear evidence, order details, photographs and any relevant supporting information.

6. Prices, VAT, currencies and payment

Prices are displayed in euros unless otherwise stated. Where applicable, prices shown on the website include VAT. Shipping costs, where applicable, are calculated and displayed during checkout before payment.

We may offer optional currency display tools for convenience. Unless expressly stated otherwise, payments are charged in the checkout currency shown at payment.

Payments are processed by third-party payment providers such as Stripe, PayPal or other payment providers made available at checkout. We do not store full credit or debit card numbers on our servers.

We reserve the right to refuse, cancel, refund, or hold an order for review where payment fails, fraud screening raises concerns, the billing or shipping information appears inconsistent, stock is unavailable, or a pricing or technical error occurred.

7. Orders and order acceptance

Placing an order is an offer to purchase the selected products. An order confirmation or payment confirmation does not necessarily mean that the order has been accepted for fulfilment. We may reject or cancel an order where there is a valid reason, including fraud concerns, payment issues, stock errors, pricing mistakes, shipping restrictions, or breach of these Terms.

If we cancel an order after payment has been taken, we will refund the relevant amount using the original payment method where possible. Refund processing times depend on the payment provider and your bank. Generally, refunds for preordered items are not accepted due to allocation management.

8. Stock availability and overselling protection

Stock availability is shown in good faith and may change quickly, especially during live sales, product launches, preorders and high-demand drops. We use technical safeguards to reduce overselling, but rare stock conflicts may still occur.

If an item becomes unavailable after you place an order, we may contact you to offer a replacement, partial fulfilment, store credit where legally permitted, or a refund for the unavailable item.

9. Preorders

Preorder products are items offered before we have completed fulfilment or before the expected product arrival. Expected release dates, arrival dates, quantities and allocations are estimates and may change due to supplier, manufacturer, distributor, customs, shipping or operational factors.

If preorder allocation is reduced or delayed, we may delay shipment, partially fulfil, cancel, or refund affected preorder items. If an order contains both preorder and in-stock items, shipment may be delayed until all items are available unless separate shipping is arranged or offered.

Preorders are subject to the same mandatory consumer rights that apply under applicable law, unless a lawful exception applies.

10. Live shop purchases and live openings

Live shop products may be offered during livestreams or live sales. Availability may change rapidly and products may sell out. A product is not reserved merely by viewing it, commenting on it, or adding it to a cart unless the checkout process is completed and the order is accepted.

If you purchase an item intended to be opened, revealed, allocated, or processed during a live stream, you acknowledge that the product may be handled or opened as part of the live sale process where you have requested or agreed to that process. Once a sealed product is opened at your request, its condition and resale value may change. This may affect cancellation, withdrawal or return options to the extent permitted by law.

We may moderate live interactions and refuse participation where behaviour is abusive, fraudulent, disruptive, or contrary to these Terms.

11. Shipping, delivery and customs

Shipping methods and prices are shown during checkout. Delivery times are estimates and are not guaranteed unless expressly stated. Processing and dispatch times may vary depending on order volume, live sale activity, preorders, weekends, holidays, customs procedures and carrier delays.

You are responsible for providing a complete and accurate shipping address. We are not responsible for delays, failed delivery, returned parcels, or extra costs caused by incorrect or incomplete address information provided by you.

Risk of loss or damage generally passes according to applicable law and delivery rules. For consumer orders, your mandatory rights remain unaffected. For business orders, risk may pass when the order is handed to the carrier, unless otherwise required by law.

International shipments may be subject to import duties, customs charges, taxes, brokerage fees, or local compliance requirements. Unless expressly stated otherwise, these charges are the responsibility of the recipient.

12. Delivery issues, lost parcels and damaged parcels

If tracking shows a delivery issue, delay, loss, damage or attempted delivery problem, contact us as soon as possible. We may ask for photographs, packaging evidence, carrier documents, delivery notes, or a written statement so that we can investigate with the carrier.

If a parcel appears damaged at delivery, you should keep the packaging, photograph the parcel before opening where possible, and notify us promptly. Do not discard packaging until the claim is resolved.

If tracking shows “delivered” but you believe you did not receive the parcel, we will review the available evidence and may assist with a carrier investigation. Refunds or replacements depend on the investigation result, applicable law, order type and carrier confirmation.

13. Consumer right of withdrawal

If you are a consumer in the European Union purchasing online, you may have a statutory right to withdraw from the contract within 14 days from the day you or a person designated by you receives the goods, unless an exception applies.

To exercise the right of withdrawal, you must inform us by email at info@shinyverse.eu with your order number and a clear statement that you wish to withdraw. You must return the goods without undue delay and in any event within 14 days after notifying us of your withdrawal, unless we agree otherwise.

Returned goods must be returned complete, protected, and in the same condition in which they were received. You are responsible for any diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. For trading cards and collector products, this includes damage, scratches, whitening, dents, seal removal, missing packaging, tampering, smoke odour, humidity damage, or other condition changes.

Unless the return is due to our error or a defective/non-conforming product, you are responsible for return shipping costs. Refunds will be processed to the original payment method where possible after we receive and inspect the returned goods, or after you provide legally sufficient proof of return shipment where applicable.

Certain goods or situations may be excluded from withdrawal rights under applicable law, including goods that are made to your specifications, clearly personalised, sealed goods that are not suitable for return once unsealed where the legal exception applies, or other goods excluded by mandatory law. Your mandatory consumer rights are not affected.

14. Returns for defective, incorrect or non-conforming goods

If you receive the wrong item, a defective item, or an item that is materially not as described, contact us as soon as possible at info@shinyverse.eu. Please include your order number, a description of the issue, clear photographs, and any relevant evidence.

We may request an unboxing video, packaging photographs, close-up photographs of the item, or return of the product for inspection. These requests help us assess the claim and prevent fraud, but they do not remove mandatory rights you may have under applicable law.

Where a claim is approved, the available remedy may include repair where appropriate, replacement, partial refund, full refund, or other remedy required by applicable law.

15. Order cancellation by customers

If you wish to cancel an order before dispatch, contact us immediately. We cannot guarantee cancellation once an order has entered fulfilment, shipping preparation, live opening processing, or dispatch. Generally, we do not offer refunds without valid reason, or if the refund request is made one (1) day after the order was placed, whichever comes first. For preorders, cancellation requests are generally not accepted due to allocation management, but we will review any request on a case-by-case basis.

Cancellation of preorders, live orders or limited products may be subject to specific order circumstances and applicable consumer law.

16. Chargebacks, payment disputes and fraud prevention

If you have an issue with an order, you agree to contact us first so that we can try to resolve it. Unfounded chargebacks, fraudulent payment disputes, false claims, return fraud, abuse of buyer protection systems, or repeated suspicious behaviour may result in order cancellation, account suspension, refusal of future orders, and reporting to payment processors or authorities where appropriate.

17. Promotions, discounts and store credit

Promotions, discount codes, store credit, giveaways or special offers may be subject to additional conditions. Unless stated otherwise, promotions cannot be exchanged for cash, may be limited to one use per customer, may exclude certain products, and may be withdrawn or changed at any time before use.

18. Intellectual property and third-party brands

All website design, text, graphics, logos, photographs, product presentation, software, and other content owned by ShinyVerse or licensed to us are protected by intellectual property laws. You may not copy, reproduce, scrape, redistribute, modify, sell, or exploit website content without our prior written permission.

Pokémon, One Piece, Magic: The Gathering, Yu-Gi-Oh!, and other product names, card names, trademarks, images, logos and intellectual property belong to their respective owners. ShinyVerse is an independent retailer and is not affiliated with, endorsed by, or sponsored by those rights holders unless expressly stated. Third-party marks are used only to identify genuine products.

19. Acceptable use of the website

You agree not to:

  • Use the website for unlawful, fraudulent, abusive or harmful purposes.
  • Attempt to bypass security, payment controls, stock controls, account restrictions or rate limits.
  • Use bots, scraping tools, automated purchasing tools, or denial-of-service methods without permission.
  • Upload or transmit malware, malicious code, spam, or harmful content.
  • Misrepresent your identity, payment details, address, age, or authority to purchase.
  • Interfere with the proper operation of the website or other customers’ use of it.

20. Website availability and changes

We aim to keep the website available and functional, but we do not guarantee uninterrupted, error-free or secure access at all times. Maintenance, updates, third-party service failures, hosting issues, payment provider downtime, cyber incidents or force majeure events may affect availability.

We may update, suspend, remove or change website features, products, live functionality, checkout options, shipping options, pricing, policies or content at any time, subject to applicable law.

21. Limitation of liability

Nothing in these Terms limits liability where such limitation is prohibited by law, including liability for intentional misconduct, gross negligence where applicable, or mandatory consumer rights that cannot be excluded.

To the maximum extent permitted by law, ShinyVerse will not be liable for indirect, incidental, special, consequential or punitive damages, loss of profit, loss of business, loss of opportunity, loss of data, reputational damage, market value fluctuations, or collector value changes.

To the maximum extent permitted by law, our total liability in connection with a product or order will not exceed the amount you paid for the specific product or order giving rise to the claim.

22. Force majeure

We are not responsible for failure or delay caused by events outside our reasonable control, including natural disasters, war, civil unrest, strikes, carrier disruption, customs delays, supplier failures, internet outages, payment provider failures, cyberattacks, government action, legal restrictions, epidemics, or other force majeure events.

23. Governing law and disputes

These Terms are governed by the laws of Greece, without prejudice to any mandatory consumer protection rights that may apply in your country of residence.

If a dispute arises, we encourage you to contact us first so that we can try to resolve it amicably. Where applicable, consumers may also seek assistance from competent consumer protection authorities or alternative dispute resolution bodies. The European Online Dispute Resolution platform has been discontinued, so customers should refer to currently available consumer redress channels.

Subject to mandatory consumer jurisdiction rules, disputes will be submitted to the competent courts of Athens, Greece.

24. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Continued use of the website after changes take effect means you accept the updated Terms.
